MEXICO CITY, DEC 19, 2013.- She is Yakiri Rubi Rubio Aupart, a 20 year-old lesbian girl accused of murdering the man who raped her when defending herself from his sexual assault. The Mexico City District Attorney’s office (PGJDF in Spanish) ignored her claim and had her arrested. Yakiri could now spend 60 years in prison. The case has created an intense debate in Mexico. Civil organizations denounce that Yakiri has been victimized twice, since authorities have practically disregarded her claim of being raped and that she killed her aggressor in legitimate self-defense. Mexico City DA’s office states that it has gone through all the legal procedures for cases similar to this one, insisting they have the evidence to indict the girl. Laura Martínez, managing director of the Comprehensive Development Program for Persons Victim of Rape (ADIVAC in Spanish) tells BBC that the authorities are violating Yakiri’s rights, something that is common in Mexico. “Women victims of sexual violence looking for justice indicate that the first thing that happens to them when they do is they get challenged. All they hear is, ‘No, what happened to you is not true, you need to prove it,’” she denounces. Yakiri’s case has gone viral in social media, including Twitter and Facebook, where a #YakiriLibre (Free Yakiri) hashtag and page has been created, and where thousands of people are requesting her freedom, she has over 55000 signatures in her change petition. 

The Ramirez Anaya brothers raped Yakiri and attempted to murder her, she fought back and Miguel Angel died out of a self inflicted wound with his own knife.

There are multiple critics on the Internet against Mexico City DA’s Office (PGJDF) as it was expressed on the ADN Politico portal by Laura Aragón, director of Mukira organization. In her text she questions the DA’s director: “Mr. Rodolfo Ríos Garza: your misinformation does not justify your machismo”, she says. Misogyny Why has Yakiri case caused such an upheaval? Because of the misogyny that apparently prevails in the justice institutions, Laura Martínez adds. She also states that it is frequent for women to be at a disadvantage in gender-related crimes. Martínez insists that for example, when women try to file a complaint for family violence the agents of the Public Ministry reject to initiate the investigation, and when they do, they integrate the file in an improper way, which makes difficult to prosecute and punish the aggressors. It also happens that in cases of sexual abuse police men blame the victims and have even sentenced the victims for manslaughter when they have had spontaneous abortions as in the states of Guanajuato and Quintana Roo, even in indigenous regions like Veracruz, Guerrero and San Luis Potosí, she indicates. Besides, in cases where women commit crimes, there are judges that give them the maximum sentences while men in the same situation have reduced sentences, critics sustain. “Misogyny permeates all realms, especially in justice and in crime areas where gender is involved, explains the managing director of ADIVAC. There are laws in the country that guarantee women a life free of violence but it is not applied in all cases, and this aggravates the problem, she insists. “If public officers continue with the regional customs we have in Mexico, where women are to be used against their will and not to be respected, this misogyny is reproduced”.

It is due to this context that Yakiri Rubi’s case is one of the most commented in social networks and many Mexican media. Since this case came to light many demonstrations and protest have taken place to request her freedom, in addition, human rights organizations insist that the girl was sent to prison through an irregular process. Mexico City DA’s office insists that it has enough evidence to keep her in prison. One of these is that Yakiri denied knowing her aggressor but PGJDF sustain there were calls and text messages between them on her cell phone, defense denies this. Lawyers and activists point that this fact does not eliminate the grounds for sexual abuse she underwent. Beyond the publicity around this case the girl will remain in prison since the trial for aggravated murder is taking place. Similar cases can be resolved in at least one year.

YAKIRI RUBÍ: LA HISTORIA CRUENTA DE UNA INJUSTICIA 

UNA MUJER CONTRA UN MUNDO DE SIMIOS MUY MACHOS

12 DE DICIEMBRE 2013.- CIUDAD DE MEXICO. Finalmente esta tarde tuve el maravilloso encuentro con mi hija Yakiri Rubí, mi pequeña princesa de 20 años. Por fin pude escuchar de sus labios, paso a paso, el terrible momento vivido por ella, en manos no solo de 2 bestias, sino de todo un aparato de justicia que conspiró a favor de sus vecinos, de sus cuates, para convertirla en unas horas de víctima de PRIVACIÓN ILEGAL DE LA LIBERTAD, ROBO, VIOLACIÓN E INTENTO DE HOMICIDIO, a una TERRIBLE HOMICIDA. 

Esta es la historia a grosso modo, contada con coraje, llanto, profundo dolor, por una mujercita de apenas 20 años, que cometió el delito de caminar por una calle de la Colonia Doctores, en busca de una cita, con su pareja que estaba en el CAVI y tuvo la desgracia de encontrarse con 2 hermanos depredadores de mujeres, que esa noche salieron a cazar a su presa:

"Cuando salí del metro para dirigirme al Super City, pues había quedado de encontrarme con ella (a una cuadra del CAVI), me empezaron a molestar un par de tipos que iban a bordo de una moto. Me decían: "Adiós flaquita", "Amiga: te llevamos" No les hice caso y seguí caminando. De pronto uno de ellos se había bajado de la moto y ya venía muy cerca de mi, insistiendo. Entonces me abrazo y me dijo: "¡Ni la hagas del pedo: Ya chingaste a tu madre!" al tiempo que me aprisionaba con un cuchillo. Con miedo pero resuelta a dejarme robar le dije: Esta bien, toma mi bolsa, llévate mi dinero... Él contestó: ¡Eso vale madre: si quisiéramos robarte, ya lo hubiéramos hecho... Súbete y no hagas pedos o aquí te carga la chingada...! Me subieron en medio de ellos, yo iba temblando, pidiéndole a Dios ya terminará esto. Me llevaron a un hotel muy cercano, que ahora se, se llama el Motel Alcázar. Ahí, uno de ellos, se quedo y el otro me abrazó con su brazo sobre mi cuello y la mano en el cuchillo, lastimándome. Cuando entramos, él saludó al administrador muy familiarmente y sin problemas, le dijo: 

-¿Qué tranza carnal?

-Ya sabes a donde - le contestó el encargado. Había también una mujer presente, que más tarde me diría: "¡Ya vete pendeja: báñate y vete! ¿Qué le hiciste? él es buena gente..."

Y así sin pagar ni hacer ningún tramite, me subió a un cuarto que estaba abierto. Enseguida llegó el hermano y entonces ambos empezaron a golpearme y a atacarme..."

Por respeto a mi hija que al llegar a esta parte rompió en llanto y durante el resto del relato sufrió más crisis nerviosas, que nos sacudieron a las cuatro personas que escuchábamos, no continuaré la historia que tendré que hacer pública en los medios si es necesario, pues me he enterado que la Procuraduria del DF, hará pública SU VERSIÓN, a modo, criminalizando a mi hija, para proteger a sus empleados, que son no solo un grave caso de corrupción y complicidad en un atentado de feminicidio, sino que además, se han convertido en protectores de delincuentes, por el simple hecho de ser sus conocidos y sus vecinos. Se trata de un caso grave de continuas violaciones de los derechos humanos y del abuso de 2 bestias que son vecinos inmediatos de la agencia 50 del Ministerio Público, situada en Doctor Lavista esquina Dr. Jimenez.

Las preguntas quedan en el aire:

¿Por qué si mi hija salió pidiendo auxilio (como consta en la declaración de los policías que acudieron a su "ayuda") por violación y después señaló a uno de los hermanos agresores (Luis Omar Ramírez Anaya) al hacer el recorrido y búsqueda, como uno de los sujetos que la agredieron, este maldito monstruo, no fue puesto a disposición y sigue libre?

¿Por qué aún no lo han detenido si tiene acusación de ser copartícipe de la violación y vive a la vuelta del MP? ¿Por qué le dijeron que tenía derecho a una llamada y a un abogado y al paso de las horas le negaron ese derecho? Le dijeron que podía marcar desde su celular, pero difícilmente salen las llamadas de ahí. Después argumentaron que era muy tarde y que mañana a las 8, podría hacerlo sin problema... Y pasaron las horas y cuando dieron las 10 am, le dijeron que ya no era necesario, porque ya se había enterado su familia... Y sin embargo yo me enteré hasta las 11:30 que mi hija estaba detenida por un pleito. ¿Por qué cuando llegué a la Agencia 50, un tipo gordo y mal humorado me dijo que mi hija, "la homicida", ya había sido trasladada y consignada al penal de Santa Martha, estrujándome el periódico, cuando mi hija aún se encontraba detenida en las galeras de esa Agencia? ¿Por qué me dijo el ministerio que ya le habían tomado su declaración hasta 3 veces y siempre se contradecía? ¿Sin abogad@ presente? ¿Es legal? ¿Por qué NUNCA se presentó la familia de la supuesta víctima (que una horas antes en la madrugada, habían querido golpear a mi hija y por eso la metieron al recinto y con su sola declaración, sirvió para cambiar el status de mi hija de víctima a victimaria) si todo el tiempo en que estuvimos nosotros, esperando por verla y ellos solo viven a media cuadra? ¿Les dijeron que no se presentaran pues alguien nos informó (discretamente) que tienen antecedentes criminales o para no complicar el caso de "agandalle" sobre una mujer que ya había sido sentenciada por la prensa amarillista y por ellos mismos en contubernio con la gente del motel y la Agencia 50? ¿Por qué la insistencia de los abogados del hotel ÁLCAZAR en tratar de sobornar a nuestra abogada? ¿Por que si existió el delito de violación, no le han suministrado anticonceptivos a la víctima? ¿Puede la gente honesta de la Procuraduria contestar estas preguntas, o responderá con periodicazos a modo, denigrando y desprestigiando a la víctima?
